CPCB / SPCB Environmental Approvals
Consent to Establish (CTE) & Consent to Operate (CTO)
Statutory consent filing, technical DPR preparation, and mandatory pollution control engineering (ETP, STP, OCEMS) for industrial, commercial, and infrastructure units. Direct liaison with State Pollution Control Boards (DPCC, HSPCB, UPPCB) and CPCB under the Water Act, 1974 & Air Act, 1981.

Consent to Establish (CTE)Mandatory before breaking ground or installing equipment. Covers DPR, zoning, water balance & proposed pollution control design.
02
Consent to Operate (CTO)Mandatory before operational startup or commercial trial. Physical verification that installed ETP/STP meets emission & discharge norms.
03
Turnkey System IntegrationGuaranteed compliance: We prepare the technical files and design the actual wastewater, air scrubbing, and OCEMS systems.
Environmental compliance in India is governed by the Central Pollution Control Board (CPCB) and implemented by State Pollution Control Boards (SPCBs) under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981.
All industrial, commercial, and infrastructure projects having an environmental impact must obtain CTE and CTO approvals from state authorities such as Delhi Pollution Control Committee (DPCC), Haryana State Pollution Control Board (HSPCB), and Uttar Pradesh Pollution Control Board (UPPCB).
Comparison: Consent to Establish (CTE) vs. Consent to Operate (CTO)
CTE and CTO represent two mandatory sequential milestones in any facility's compliance lifecycle.
STAGE 1 · BEFORE SETUP
Consent to Establish (CTE)
Timing: Required before starting civil construction, installing plant machinery, expanding capacity, or altering processes.
Evaluation Basis: Theoretical project feasibility, Detailed Project Report (DPR), site layout plan, water balance, and proposed pollution control designs.
Key Risk: If technical design or pollution load is underestimated at CTE stage, Consent to Operate (CTO) will be rejected later.
STAGE 2 · BEFORE OPERATIONS
Consent to Operate (CTO)
Timing: Required after project installation is completed and before starting commercial production or opening to guests/public.
Evaluation Basis: Performance-based physical verification that installed systems match CTE conditions and meet actual stack and effluent discharge limits.
Validity: Granted for 1 to 10 years based on pollution category; periodic renewal is mandatory to prevent operational closure notices.
01
CPCB (Central Board)
Lays down national environmental standards, emission limits, effluent parameters, and uniform categorizations across India.
02
SPCBs / DPCC (State Boards)
Grants CTE/CTO consents, conducts physical site inspections, issues show-cause notices, and monitors local environmental compliance.
03
State-Level Approvals
All consent applications are processed through regional SPCB portals (OCMMS) aligned with statutory CPCB environmental guidelines.
PRE-CONSTRUCTION APPROVAL
Consent to Establish (CTE): Application & Readiness
Consent to Establish is a statutory engineering evaluation of your facility before construction. Incomplete documentation or faulty system design are the leading causes of rejection.
MANDATORY TRIGGERS
When is Consent to Establish (CTE) Required?
01
Starting construction of any new commercial or industrial facility
02
Installing production plant, boilers, DG sets, or industrial machinery
03
Expanding manufacturing capacity or building area of an existing unit
04
Modifying production processes, raw materials, or product outputs
TECHNICAL EVALUATION
5 Core Components of a CTE Application
CTE is not just a form; it is a thorough technical evaluation of environmental load and planned mitigation systems.
01
Detailed Project Report (DPR)
Nature of industry & detailed manufacturing process flow
Installed production capacity & operational shifts
Raw materials, chemicals, and final product outputs
02
Land, Zoning & Site Plan
Master plan conforming industrial/commercial zoning compliance
Ownership title deed or registered lease agreement
Site layout showing machinery, ETP/STP, DG sets & green belt
Most rejections stem from poor technical preparation rather than legal technicalities.
!
Incorrect Categorization
Applying under Orange or Green when project processes belong in Red category causes instant application return.
!
Incomplete Project Reports
Missing manufacturing mass balances, chemical usage details, or vague raw material declarations.
!
Unrealistic Pollution Designs
Proposing undersized ETP/STP capacities that fail to address peak hydraulic and organic pollution loads.
!
Zoning Non-Compliance
Establishing polluting industrial activities in non-conforming agricultural or residential zones.
PRE-COMMISSIONING APPROVAL
Consent to Operate (CTO): Conditions & Renewal
Consent to Operate verifies actual operational readiness. CTO confirms that physical pollution systems are commissioned, fully operational, and compliant with prescribed discharge norms.
OPERATIONAL CONDITIONS
Key Conditions for Grant of CTO
01
Strict CTE Compliance
Actual physical installation must match approved CTE plans
No unapproved machinery or unapproved expansion
02
Functional Treatment Systems
ETP and STP fully installed, wired, and biological culture seeded
Oil & grease interceptors installed in drainage lines
03
Emission & Discharge Limits
Stack air emissions must meet CPCB particulate limits
Treated effluent must meet BOD, COD, and TSS parameters
04
Online Telemetry (OCEMS)
Mandatory for 17 highly polluting and Red category industries
Continuous 24x7 telemetry link to CPCB & SPCB servers
05
Physical Site Inspection
SPCB Regional Officer physically inspects site operations
Field water and stack emission samples are collected and tested
TIMELINES & EXTENSIONS
Validity of CTO & Periodic Renewal
CTO validity is determined by industry category and state-specific board norms. Renewal must be filed 60–90 days before expiry to avoid operational closure.
RED CATEGORY
Valid for 1 to 5 Years
Subject to stringent compliance reviews, frequent board sampling, and strict telemetry uptime monitoring.
ORANGE CATEGORY
Valid for 5 Years
Moderate monitoring frequency with scheduled renewal inspections and annual compliance reporting.
GREEN CATEGORY
Valid for up to 10 Years
Extended validity with simplified desk review renewal, provided production capacity remains unchanged.
STATUTORY CLASSIFICATION
Industry Categorization: Red, Orange, Green & White
Every commercial, institutional, and industrial activity in India is classified under CPCB guidelines based on its Pollution Index (PI) score. Categorization determines the approval pathway, fees, validity, and inspection severity.
RED CATEGORY · PI 60+
High Pollution Potential
Examples: Chemical synthesis, electroplating, heavy fabrication, pharmaceuticals, thermal power, large dye houses.
Examples: Small assembly units, flour mills, dry packaging, small garment making, spice grinding without effluent generation.
Requirements: Simplified online consent, domestic sewage disposal, valid up to 10 years.
WHITE CATEGORY · PI ≤ 20
Non-Polluting Category
Examples: Solar power plants, wind energy, software and IT development units, bicycle assembly, dry cotton packaging.
Requirements: Exempt from CTE/CTO consent. Requires only a simple online self-declaration intimation.
